These Terms of Service ("Terms") govern your use of the Defenras browser extension and website (collectively, the "Service") operated by 2380616 Ontario Inc. ("Company," "we," "us," or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Defenras is a browser extension designed to block access to known malicious, phishing, adult content, gambling, and scam websites. The Service uses locally-stored blocklists and pattern-based detection to identify and block potentially harmful web content.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DEFENRAS IS A SUPPLEMENTARY SECURITY TOOL AND IS NOT INTENDED TO BE A COMPLETE OR SOLE SOLUTION FOR INTERNET SAFETY, CONTENT FILTERING, OR CYBERSECURITY.
WE DO NOT WARRANT, GUARANTEE, OR REPRESENT THAT THE SERVICE WILL:
(a) Block, detect, identify, or prevent access to all malicious, harmful, inappropriate, adult, phishing, scam, gambling, or otherwise objectionable content on the internet;
(b) Provide complete protection against malware, viruses, trojans, ransomware, spyware, or any other form of malicious software;
(c) Be free from errors, bugs, interruptions, or security vulnerabilities;
(d) Function correctly on all websites, browsers, operating systems, or devices at all times;
(e) Prevent all phishing attacks, social engineering attempts, or identity theft;
(f) Block all adult, explicit, pornographic, violent, or age-inappropriate content;
(g) Provide adequate parental controls as a standalone solution for child internet safety.
New threats emerge constantly, and no content filtering tool — including Defenras — can guarantee 100% accuracy or coverage. Some harmful content may bypass our filters, and some legitimate content may be incorrectly blocked (false positives). Users should not rely solely on Defenras for internet safety.
Defenras is a tool to assist parents and guardians in managing internet access for minors. It is NOT a substitute for active parental supervision. Parents and guardians remain solely responsible for monitoring their children's internet usage and ensuring their safety online. The Company shall not be held liable for any content a minor may access, view, or interact with while using or not using the Service, regardless of whether the Service was installed, active, or functioning at the time.
We strongly recommend that parents and guardians use Defenras in combination with other safety measures, including but not limited to: direct supervision, open communication about online safety, device-level parental controls, and network-level content filtering.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
(a) Direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Service;
(b) Damages arising from any content that the Service failed to block, filter, detect, or prevent;
(c) Damages arising from exposure to malicious, harmful, inappropriate, adult, explicit, or objectionable content that bypassed the Service's filters;
(d) Damages arising from malware, viruses, phishing attacks, data loss, identity theft, or financial loss that occurred despite the Service being installed;
(e) Damages arising from the Service incorrectly blocking legitimate content (false positives);
(f) Damages arising from any psychological, emotional, or physical harm resulting from exposure to content the Service failed to block;
(g) Loss of data, profits, revenue, business, or goodwill;
(h) Damages arising from unauthorized access to, or alteration of, your data or transmissions.
IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS (USD $50.00), WHICHEVER IS LESS.
This limitation of liability applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other basis, even if the Company has been advised of the possibility of such damage.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your requirements, that the operation of the Service will be uninterrupted, timely, secure, or error-free, or that defects in the Service will be corrected. No advice or information, whether oral or written, obtained by you from the Company shall create any warranty not expressly stated in these Terms.
You agree to defend, indemnify, and hold harmless the Company, its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any claim that the Service failed to adequately block, filter, or prevent access to any content.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use. You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or create derivative works based on the Service. Each license key permits installation on up to six (6) browser instances.
Paid plans are billed in advance on a monthly, annual, or one-time basis depending on your selected plan. Monthly and annual subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time.
We offer a 15-day money-back guarantee from the date of purchase. Refund requests made within 15 days of the original purchase will be processed in full. Refund requests after this period will not be honored. To request a refund, contact support@defenras.com.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to circumvent, disable, or interfere with the Service's security features; (c) share, transfer, or resell your license key; (d) use automated tools to abuse the Service's activation or trial systems; (e) reverse engineer or decompile any part of the Service.
Defenras processes all content filtering locally on your device. We do not collect, store, transmit, or have access to your browsing history, search queries, or personal data. The only data stored on our servers is: (a) your license key and activation status; (b) a randomly generated device identifier; (c) your Guardian Alert email address (if enabled). We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms from time to time. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your license to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Ontario, Canada.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between you and the Company regarding the use of the Service, superseding any prior agreements between you and the Company relating to the Service.
